Publication required

Georgia requires new entities to publish notice of formation. Publication applies to CORPORATIONS only (profit and nonprofit) — LLCs are EXEMPT. A corporation must publish a Notice of Intent to Incorporate in the official legal organ newspaper of the county where the initial registered office is located (or a general-circulation paper meeting the 60% paid-subscription rule). The $40 publication fee is paid directly to the newspaper, not to the Secretary of State. Notice runs once a week for two consecutive weeks. Deadline: Corporations only: send the notice and $40 fee to the newspaper no later than the next business day after filing the Articles of Incorporation.. We flag it so you don't miss it.

FAQ

Georgia registered agent questions

Do I need a registered agent in Georgia?

Yes. Georgia — like every US state — requires your LLC or corporation to maintain a registered agent with a physical Georgia address, available during business hours to receive legal documents and state mail. You can be your own agent only if you have a Georgia street address and are personally available every weekday.

Can I use Kicker as my Georgia registered agent if I live abroad?

Absolutely. Non-US founders can't be their own registered agent because a US address is required. We provide a compliant Georgia address and handle every document that arrives — this is one of the most common reasons international founders use us.

Will you remind me about my Georgia annual report?

Yes. Due April 1 of each year (may be filed as early as January 1). Same April 1 deadline regardless of formation date. We track that date and remind you ahead of it — and we can file the report for you too.

How do I switch my Georgia registered agent to Kicker?

After you sign up we prepare the Georgia change-of-agent form, file it with the state, and confirm when it's active — usually within 1–5 business days. Your current agent is notified automatically through the state filing.
