E-Sign Consent Agreement
Your consent to receive electronic communications, sign documents digitally, and access all tax, financial, and legal formation documents electronically.
This Electronic Signature and Communications Consent Agreement (“E-Sign Consent”) describes how Cannki Kicker (“we,” “us,” or “our”) delivers communications to you electronically and how you consent to receive documents, disclosures, and notices in electronic form. This consent is provided in compliance with the Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA). By using our platform, you agree to the terms outlined below.
1. Scope of Consent
By creating an account or using any Cannki Kicker service, you consent to receive all communications, documents, disclosures, and notices (collectively, “Communications”) electronically, including but not limited to:
Tax & IRS Documents
- IRS E-Filing Authorizations: Forms 8879, 8453, and any other IRS authorization forms required for electronic filing of your tax returns
- Tax Return Documents: Completed tax returns, schedules, worksheets, and supporting documentation prepared through our platform
- Tax Forms: W-9, W-7, SS-4, and other IRS forms generated or submitted on your behalf
- Filing Confirmations: E-filing acknowledgments, acceptance/rejection notices, and IRS correspondence related to your filings
Legal Formation Documents
- Formation Documents: Articles of Organization, Articles of Incorporation, Certificates of Formation, and all state filing documents
- Operating Agreements & Bylaws: LLC operating agreements, corporate bylaws, resolutions, and organizational documents
- Compliance Documents: BOI (Beneficial Ownership Information) reports, annual reports, and regulatory filings
- EIN & ITIN Confirmations: IRS-issued Employer Identification Numbers and Individual Taxpayer Identification Number assignment letters
Account & Service Communications
- Account opening disclosures, terms of service, and privacy policies
- Billing statements, invoices, receipts, and payment confirmations
- Service agreements, amendments, and policy updates
- Banking and financial account disclosures from Stripe and partner banks
- Identity verification results and compliance notifications
2. Hardware & Software Requirements
To access, view, and retain electronic Communications from Cannki Kicker, you will need the following:
- • A computer with an internet connection
- • A modern web browser (Chrome, Firefox, Safari, or Edge — latest two major versions)
- • JavaScript and cookies enabled
- • A PDF reader (such as Adobe Acrobat Reader or built-in browser PDF viewer)
- • Sufficient storage to save or print documents
- • A smartphone or tablet with internet access
- • iOS Safari or Android Chrome (latest two major versions)
- • Ability to view PDF documents on the device
- • An active email address to receive notifications
- • Sufficient storage to download and retain documents
Additional Requirements
- Active Email Address: A valid, functioning email address that you check regularly. We will send notifications to this email when new Communications are available
- PDF Reader: Adobe Acrobat Reader (free) or any equivalent PDF viewing software to view, download, and print documents delivered in PDF format
- Printer (Optional): A printer if you wish to print paper copies of electronic Communications for your records
3. Consent to Electronic Signatures
By using our services, you agree that your electronic signature on any document or form has the same legal validity, enforceability, and effect as a handwritten signature. Your electronic signature may take the form of:
- Click-to-Sign: Clicking an “I Agree,” “Sign,” “Submit,” or similar button on our platform
- Typed Signature: Typing your name into a designated signature field
- Drawn Signature: Drawing your signature using a mouse, touchscreen, or stylus
- Authentication-Based: Authenticating your identity through our platform (login, biometric verification) and confirming your intent to sign
4. Withdrawal of Consent
You have the right to withdraw your consent to receive electronic Communications at any time. However, please be aware of the following important consequences:
Consequences of Withdrawing Consent
- Tax Filing Services: Withdrawal of e-sign consent will result in the termination of your ability to use our software for IRS e-filing, as electronic signatures are required for IRS Forms 8879 and other e-filing authorizations
- Banking & Financial Services: Withdrawal may result in the termination of your access to embedded banking features, corporate cards, and financial accounts provided through Stripe and partner banks, as these services require electronic consent for account agreements and disclosures
- Business Formation Services: Certain formation and compliance services may be unavailable or delayed, as many government filings require electronic authorization
- Account Restrictions: Some or all features of your Cannki Kicker account may become inaccessible until consent is reinstated
How to Withdraw Consent
To withdraw your consent to electronic Communications, you may:
- Email us at contact@kicker.cannki.com with the subject line “Withdraw E-Sign Consent”
- Contact us by phone at +1 (219) 841-1596 during business hours
- Send written notice to our mailing address listed below
Withdrawal of consent will be effective within 5 business days of receipt. Withdrawal does not affect the legal validity of any electronic Communications or signatures provided prior to the effective date of withdrawal.
5. Requesting Paper Copies
Even after consenting to electronic delivery, you may request paper copies of any Communication. To request a paper copy, contact us at contact@kicker.cannki.com or call +1 (219) 841-1596. A reasonable fee may be charged for paper delivery to cover printing and mailing costs. We recommend downloading and saving electronic copies of all important documents for your records.
6. Updating Your Contact Information
It is your responsibility to keep your email address and other contact information current. If your email address or other information changes, you must update it promptly in your account settings or by contacting our support team. Failure to maintain current contact information may result in missed Communications, including time-sensitive tax and legal documents.
7. Legal Effect & Federal Law
This E-Sign Consent is governed by the Electronic Signatures in Global and National Commerce Act (ESIGN Act, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA) as adopted by your state of residence. Under these laws, electronic records and signatures carry the same weight and legal effect as paper documents and handwritten signatures. By consenting, you acknowledge that you have read this agreement, understand the terms, and agree to conduct transactions electronically with Cannki Kicker.
8. Changes to This Agreement
We reserve the right to modify this E-Sign Consent Agreement at any time. If we make material changes, we will notify you by email or through a prominent notice on our platform. Your continued use of our services after such notification constitutes your acceptance of the updated agreement. If you do not agree to the changes, you may withdraw your consent as described in Section 4.
